Let’s accept the fact that for most people, divorce is going to be a not-so-fun experience. Rarely do couples divorce with absolutely zero things to dispute over. One of the most tense-filled discussions couples may have, is who is awarded alimony and for how much. Is an Agreement Outside of Court Possible?

Even though alimony can be a heated topic, it is possible for both spouses to reach an agreement if they both are committed to doing so with help from an attorney. Having an attorney on your side during alimony disputes can help ensure that neither spouse is left in financial ruin after divorce. However, if both spouses fail to reach a middle ground through mediation and attorney support, then they will have to attend a hearing in front of court judge who will decide alimony terms for them instead. 

One Time or Monthly Payments?

Whoever is deemed more in need of financial help from the other spouse, may receive payment through a large lump sum, or smaller amounts over a period of time. The spouse who has to pay into alimony may no longer have to once the former spouse remarries, obtains financial independence, children have reached adulthood, or some other significant live event happens. 

What Should Be My Expectations? 

Spouses who are caught up in their emotions due to the divorce may not have a realistic expectation for the alimony arrangement. If the spouses are completely at-odds and both expect the other to pay money to them, then they are at a stand-still and will probably have to attend court. 

An attorney may have to gently remind a spouse that what it comes down to are numbers and figures. If one spouse has consistently made more than the other during the marriage, then it is unlikely that the spouse who didn’t earn much is going to pay alimony. But, what an attorney can do is help protect the paying spouse from being taken advantage of, or at the same time help a spouse get the amount they need to minimize hardships after divorce.

What Can I Do To Prepare?

Any spouse that is currently going through divorce, must consult with a legal professional as quickly as possible to ensure their rights and future are being protected. Especially when it comes to alimony, if an unfair amount is agreed upon then this could mean one spouse endures unnecessary financial turmoil. The best thing a person can do to prepare for alimony negotiations is to organize their financial files and meet with an attorney for advice over a consultation.
