How to Retain the Services of a Lawyer if You Can’t Afford One

Getting arrested and facing the prospects of spending time behind bars is frightening enough. Once you understand how much an attorney costs, you may realize that your financial life will never be the same either. Experienced attorneys charge a handsome fee for their services, especially in complex criminal cases. The good news is that you the right to legal representation. If you can’t afford to hire a private attorney, there are ways to still retain a lawyer to defend you.

Court-Appointed Counsel

Many people are familiar with the portion of the Miranda rights that states, “You have the right to a lawyer with you” and that if you can’t afford one “a lawyer will be provided for you. Known as a public defender, this lawyer can represent you in your criminal case at no cost to you. To qualify for one, you must show that you have an economic hardship. This lawyer has the training and experience you can feel good about in being your advocate. Public defenders will do the same type of work and take similar steps than any private attorney would take. Your lawyer will ensure that your rights are respected, that you get a fair trial and that you have the best chance possible of getting a positive outcome.

Pro Bono Services

Attorneys are encouraged to occasionally donate their time and take on a client’s cost at a reduced cost (or no cost at all). In some legal circles, lawyers are encouraged to provide up to 50 hours a year of pro bono work. Often, younger up-and-coming attorneys will take a case for free as a way to gain more experience and generate a positive reputation. The state bar association where you live can help you identify local attorneys who are willing to take your case pro bono.

Consultations

Many attorneys and law firms offer free consultations. If you need legal help, you could meet with a few lawyers in the area and explain the nature of your case. The lawyer can give you advice and direction on how to proceed in your defense.

Self-Representation

A last-case resort should be representing yourself. This is an effective way to save money, though you won’t have nearly the same level of skill and training that a criminal justice attorney has.
